WHAT IS
PARENTAL ALIENATION?

Parental alienation is when one parent deliberately undermines the relationship between their child and the other parent. The alienating parent may use various tactics such as speaking negatively about the other parent, withholding affection or preventing the child from spending time with the targeted parent. In extreme cases, the alienating parent may even manipulate the child into believing that the targeted parent is dangerous or undeserving of their affection and care.

Cynthia and her team are great! I hired Cynthia a week before my hearing and she made sure that she was prepared, up to date and knowledgeable about my case and handled everything in time for my hearing with very little time. Also she reached out with everything and responded quickly. She made sure that my concerns, my position and evidence were heard and having her at this hearing made all the difference for me. I’m happy I went with Modern Family Law and Cynthia, this has been mentally and emotionally draining for me to go through and as soon as Cynthia came abroad I was able to be relived of that and knew I was in good hands. My hearing went in my favor and I believe it’s because I had Cynthia. Now I can get back to my life and focus on other things and I’m just so grateful for Cynthia and her teams help.

Brian Litzinger with Modern Family Law and I have been working together for about 4 years. He did an amazing job for me as I was going through a very difficult long custody battle for my Daughter. He helped keep me sane and is very kind and compassionate and understanding. He is the best attorney I have ever worked with and I highly recommend him. Oh, and I now have full custody of my Daughter.

FREQUENTLY ASKED QUESTIONS ABOUT
PARENTAL ALIENATION IN CALIFORNIA

What Should I Do If I Suspect My Child Is Being Alienated From Me?

If you suspect that your child is being alienated from you, it is important to take action as soon as possible. Consult with an experienced family law attorney in California to discuss your options, including seeking a court order to protect your relationship with your child. You may also consider counseling or therapy for yourself and/or your child to address any emotional or psychological effects of the alienation.

What Remedies Do California Courts Provide In Parental Alienation Cases?

A judge can modify custody orders and use reunification therapy to integrate a parent back into a child’s life in cases of parental alienation. The judge may also order counseling for the ex-spouse and remind them to follow the custody and visitation order.

What Evidence Is Needed To Prove Parental Alienation In California?

To prove parental alienation in family court, evidence is crucial. Some of the evidence that can support your claim include:

  • Testimony from therapists or counselors who observe parental alienation syndrome in the child can be obtained through a court order if necessary.
  • Testimony from witnesses such as family, friends, and neighbors who have witnessed your ex-spouse denigrating you. This testimony is not hearsay because it proves your ex-spouse’s words are false.
  • Social media posts that your ex-spouse made to or about your child, as well as your child’s social media posts that reflect how they view you.
  • Text messages, emails, and voicemails from your ex-spouse, especially those containing angry or hostile messages that your child may repeat to prove parental alienation.
