“When we talk about protective orders at the firm, it’s usually in the context of family law,” says Mohseen. “But protective orders can also be issued through the criminal process. For example, when police are involved, a magistrate judge can issue an Emergency Protective Order right away.”
In family law cases, survivors typically begin by filling out standardized Texas forms and submitting an affidavit describing the abuse. Depending on the urgency, a person may request either a standard protective order or an ex parte protective order, the latter being issued without notifying the other party if immediate safety is at risk.
“In urgent cases, we may appear before a judge within a day or two,” Mohseen notes. “If the judge determines there’s an immediate threat, a temporary ex parte order is issued that prohibits contact until a final hearing is held.”

“Protective orders carry serious consequences,” Mohseen says. “They’re designed to keep victims safe, but they can also have ripple effects on employment or immigration — so we help clients understand every part of the process.”
How Domestic Violence Impacts Custody & Conservatorship
Texas family courts use the term “conservatorship” rather than custody, and judges must consider evidence of family violence when determining parenting arrangements.
“If a judge makes a finding of family violence — even without a protective order — that factor must be weighed when deciding conservatorship,” Mohseen explains. “In many cases, it results in one parent being named sole managing conservator while the other becomes a possessory conservator.”
